ANPRM on the Removal of Certain Division 1.1 Explosives from CFATS

The Cybersecurity and Infrastructure Security Agency (CISA) has published a notice in the Federal Register seeking public comment on an Advance Notice of Proposed Rulemaking (ANPRM) that considers removing certain Division 1.1 explosives from the list of regulated Chemicals of Interest in Appendix A of the Chemical Facility Anti-Terrorism Standards (CFATS) regulation.

The ANPRM on the Removal of Certain Explosive Chemicals from the Chemical Facility Anti-Terrorism Standards would remove forty-nine Division 1.1 explosive chemicals from Appendix A. Division 1.1 explosive chemicals are also subject to security regulations implemented by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

An ANPRM is the first step in the rulemaking process and is intended to gather public input and stakeholder feedback. The ANPRM on the Removal of Certain Explosive Chemicals from the Chemical Facility Anti-Terrorism Standards is open for comment for sixty days to March 7, 2021.
